We signed a contract with FiveStar Foundation & Construction in October 2023 to get a slab poured for a metal building, new approach and culvert for driveway, and work on drainage. We paid a 50% deposit per the contract that was $9,925.00. We had to get the permits for the work which were good for 6 months. We kept getting put off on the schedule for one reason or another by the company. We were finally put on the schedule, with enough time left on the permits and to not lose our contract on the metal building. Some crew workers showed up a week later than was scheduled. Two days of some minor prep work was completed and then no one showed up again. In trying to contact the company, it would take multiple calls to the cell phone number given, and calls and texts to the office number, and finally written and dated notices by text to get any kind of response. Our permits expired which the company said they would renew, but then did not. The work wasn’t completed and no new schedule was provided. The last communication from the company on our contract was originally on May 4th that we would be contacted on Tuesday (May 7th) by Dakota Link (aka Kody) for status of the project and then the company went silent. They failed to complete the job contracted for. We emailed a letter per the contract for termination for breach of contract by FiveStar Foundation & Construction and demanding a refund of our deposit, and received no response. Letter was sent as a certified letter for contract termination and for a 100% refund of our deposit. As email had been the way to communicate aside from text messages, we also emailed a copy of the termination letter for breach of contract and refund request. The physical letter was returned as undeliverable, no such number for address. This same address was used to register with the city to be allowed to do the work that was contracted. No response from the email. We could not get any response out of them until I started filing complaint with the BBB and posting reviews. There was 1 phone call from Kody with a message left after I started posting reviews. We tried to call back multiple times, left messages, and got no response. Also, no refund was issued. Complaint to the BBB went unanswered and the address that shows on the BBB for them is not the one that was used to register for work in our city either. A bad review was removed from their Facebook page and then they blocked my Facebook account. The subcontractors hired that did the minor prep work even showed up at our house asking about the job because they were not paid for any work. The company has since changed their number and their service areas no longer includes Houston as a service area. We have attempted to chat with them on the new website and no response. We have sent through their request form a follow up on the termination and refund still owed, with no response. We have tried calling the new number and received no response. We still have not been refunded our money.
