Wrongful Termination Summary

Wrongful Termination SummaryCompany: Pacific Bath – Las Vegas, NVPosition Offered: March 28, 2025 (via written employment contract – available upon request)Previous Employer Resignation Date: April 16, 2025 (resigned in writing from Bath Fitter to prepare for a new role)Start Date at Pacific Bath: April 28, 2025Training Location: Portland, OROn Sunday, April 27, 2025, Pacific Bath flew me from Las Vegas to Portland and provided lodging for the training program. I reported to the training center the next morning, April 28. The training was led by Dennis Foster, while my assigned branch manager in Las Vegas was Terrence O'Leary.Important: I was offered the position verbally on the 27th of March by Branch manager Terrence O’Leary on Due to technical issues with their internal systems, I was unable to begin the training modules right away. During this waiting period, Dennis Foster frequently shared his political views, which sharply conflicted with my own. Although I did not verbally challenge him, I found the commentary inappropriate in a professional setting. It's possible my reaction or facial expressions gave him reason to take offense. On Tuesday, April 29, at approximately 2:00 p.m.—the second day of training—Dennis Foster called me into his office and abruptly informed me I was being terminated. When I asked for an explanation, he refused to provide one. I returned to the hotel that night and flew back to Las Vegas the following morning.I believe my termination was wrongful and likely driven by one or more of the following factors:1. Age Discrimination: I am 68 years old, while the average age of Pacific Bath's sales team appears to be around 45.2. Personal Bias: Dennis Foster may have taken a personal dislike to me, potentially influenced by our differing political views and the delays in system access. No formal training or performance assessments had occurred prior to my termination that could justify dismissal.3. I was terminated from my position at Pacific Bath after receiving a clear written offer of employment. Relying on this offer, I was led to believe that the position was secure. As a result, I resigned from my previous role at Bath Fitter in preparation for the new opportunity. However, after I resigned and before I officially began work at Pacific Bath, I was terminated without cause. This constitutes a breach of contract and caused significant professional and financial harm.Summary: I was wrongfully fired from a job I am infinitely qualified to perform. I was terminated without cause other than my age, which was one major factor. And, of course, Dennis Foster brought his politics into the classroom, which was unprofessional at best. I am seeking damages from the Pacific Bath Company. And at 68 years of age, it isn't easy to replace what was taken from me unilaterally at the hands of Dennis Foster. Lary Sims
